MiCash360 End-User Agreement

1. Introduction

Welcome to MiCash360 ("Service"). This End-User Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and MiCash360 ("MiCash360," "we," "us," or "our"), a service provided by MiCash360(Pty) Ltd, a South African company registered with number 2021/124114/07. Our solution is enabled by MiCash360(Pty) Ltd, which acts as an Operator as defined in the Protection of Personal Information Act, 2013 (POPIA), and handles all personal information in accordance with our privacy policy. By accessing or using the Service, you agree to comply with and be bound by the terms and conditions of this Agreement.

2. Definitions

Service: The online payment gateway provided by MiCash360.

User: Any individual or entity using the Service.

Merchant: Any individual or entity that uses the Service to accept payments from Users.

MiCash360(Pty) Ltd: The company providing the underlying payment services for MiCash360.

PCI/DSS: Payment Card Industry Data Security Standard, a set of security standards designed to ensure that all companies that accept, process, store, or transmit credit card information maintain a secure environment.

3. Eligibility

By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are using the Service on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to this Agreement.

4. Services Provided

MiCash360 provides online payment gateway services that allow Merchants to accept payments from Users. These services are enabled through MiCash360(Pty) Ltd and comply with all applicable regulatory requirements, including PCI/DSS standards.

5. User Responsibilities

As a User, you agree to:

• Provide accurate, current, and complete information during the registration process and keep such information updated.
• Use the Service only for lawful purposes and in accordance with this Agreement.
• Maintain the confidentiality of your account credentials and promptly notify MiCash360 of any unauthorized use or security breach.

6. Merchant Responsibilities

Merchants using the Service agree to:

• Comply with all applicable laws, regulations, and standards, including PCI/DSS.
• Accurately represent their goods or services and not engage in any deceptive, fraudulent, or illegal activities.
• Ensure that their systems and processes are secure and do not compromise the security of the Service.

7. Fees and Payments

Fees for using the Service will be as agreed upon between MiCash360 and the Merchant. MiCash360 reserves the right to change its fee structure at any time with prior notice to the Merchant.

8. Compliance and Security

MiCash360 and MiCash360(Pty) Ltd comply with all regulatory requirements, including PCI/DSS standards. We are committed to maintaining the highest level of security to protect your payment information.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and share your information.

10. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, trademarks, and logos, are owned by MiCash360 or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

11. Limitation of Liability

To the fullest extent permitted by law, MiCash360, MiCash360(Pty) Ltd, and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Service.
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Service by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

12. Termination

MiCash360 reserves the right to terminate or suspend your access to the Service at any time, without notice, for any reason, including but not limited to breach of this Agreement. Upon termination, all provisions of this Agreement that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

14. Amendments

MiCash360 reserves the right to modify or amend this Agreement at any time. We will notify you of any changes by posting the new Agreement on our website. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.
